Should these Terms of Service be regarded as an offer, acceptance is explicitly confined to these Terms of Service.

We retain the right to update, modify, or substitute any section of these Terms of Service by publishing updates and/or alterations on our website. It is your obligation to periodically review this page for modifications. Your ongoing use or access to the website subsequent to the publication of any changes signifies your acceptance of those revisions.

Commission Agreement

Upon confirming your intent to proceed with the provided quote, a contractual agreement for the commission will be formalized. Following this, we will send you an email containing the quote and a specification outlining the commission's details. It is imperative for the client to ensure that all necessary details are provided before the commencement of work.

The contractual commitment persists throughout the duration required for us to fulfill the commissioned services. By engaging in a commission with SW Painting Studio, the client commits to initiating a bespoke miniature painting project, adhering to the provided specifications.

 

Painting Services

SW Painting Studio offers four painting levels and matching basing levels among our services referred to as ‘Battlefield’, ‘Elite’, ‘Commander’ and ‘Legendary’. Full explanations of each level and tier can be found at our Painting Services page.

SW Painting Studio has the discretion to adjust the names or descriptions of any service tiers. Additionally, we hold the right to refuse a specific service level for a particular model if we determine that the model's quality does not correspond with the outlined descriptions of our service levels.

Details of the painting process, including techniques, paints, and equipment, will not be disclosed to the client under any circumstances to safeguard our business.

 

Assembly Services

As part of your commission with SW Painting Studio, we offer an optional building and cleaning service. While we recommend this service to ensure our involvement in every step, we acknowledge that some clients may have already initiated the building process. Clients must indicate at the inquiry stage whether they prefer us to handle the building and cleaning or if they have already completed this step. If the client opts not to use our service, the models must be sent fully built and cleaned to meet SW Painting Studio standards.

 

Our standard for building and cleaning encompasses, among other criteria:

  • Complete removal of all model parts from their sprue

  • Absence of visible sprue join marks on the model

  • Seamless connection and closure of model parts with no visible gaps

  • Thorough cleaning or removal of all mold lines

  • Smooth surfaces on all cleaned areas.

 

If a client doesn't opt for our building and cleaning service but sends models that don't meet our specified standards, SW Painting Studio will assess the condition. The client then has three options: (a) pay the necessary building and cleaning charges, (b) request return with cancellation at the client's expense (refer to commission cancellations section for details), or (c) request return and restart the commission with the purchase of new models. If option (c) is chosen, a model supply cost will be issued and must be paid for the commission to proceed. SW Painting Studio reserves the right to cancel a commission and return the models if they are deemed unsuitable for work, regardless of the client's agreement with the assessment.

 

Conversions & Custom work

​

SW Painting Studio offers optional model converting and sculpting services to clients commissioning our work. These services are estimated in the quote at an hourly rate, with the duration determined by SW Painting Studio. We reserve the right to decline a conversion or custom request if we believe it cannot be effectively executed. In such cases, clients will be notified, and a quote for the remaining services will be provided.

SW Painting Studio provides optional Freehand Painting and Freehand Banner Painting services for clients commissioning our billed at an estimated hourly rate, and the duration is determined by SW Painting Studio.

​

Due to the individualisation and time required to complete, payments for the freehand banner painting service are required in full in advance. Without receiving 100% payment, we reserve the right to decline your freehand banner painting request.

​

SW Painting Studio retains the right to decline Freehand Painting or Freehand Banner Painting requests. In such instances, clients will be notified, and a quote for the remaining services will be provided.

 

Throughout the Commission

​

Once a quote is accepted and the initial payment is made, the commission joins the SW Painting Studio waiting list. The waiting times are estimates, subject to change due to unforeseen circumstances like client-requested alterations. It's crucial to note that the waiting list duration is not indicative of the completion time.

​

The waiting list comprises three categories - 'Force,' 'Minor Project,' and 'Individual.' SW Painting Studio determines the placement.

​

Current waiting times:

- Force: 6 months

- Minor Projects: 3 months

- Individual: 1 month

​

If the same client pays a new deposit for a new commission during the period between deposit and completion, SW Painting Studio may combine the commissions without notifying the client.

​

SW Painting Studio reserves the right to alter waiting lists without client notification. These estimates are guides, and we may extend the start time if necessary.

​

Throughout the project, clients can expect regular photo updates, and they are encouraged to reach out at any stage for progress inquiries.

​

Modest alterations are welcome during the project, defined as changes that do not substantially extend the working time. The determination of alteration significance is made by SW Painting Studio. Examples include adding grass tufts or altering minor details like sword handles or belts.

For changes that significantly extend working time, SW Painting Studio, if not at fault, reserves the right to refuse or issue an additional invoice. Examples of significant changes include changing the primary or secondary colour of cloth, armour or weapons or the addition of object source lighting or freehand.

 

Pricing

​

SW Painting Studio will generate a personalized quote tailored to your specific inquiry. The Pricing Guide is not binding and does not constitute an offer of service. The miniatures mentioned in the Pricing Guide serve as references to provide an estimate before issuing an official quote. We retain the right to adjust pricing as needed before presenting you with a quote in response to your inquiry.

Upon receiving a quote, its validity extends for 30 days unless explicitly withdrawn by us. We reserve the right to correct any mistakes within your quote at any time during these 30 days.

SW Painting Studio establishes service pricing based on factors including the model's size, level of detail, the client's requested paint scheme or specific process, the chosen painting tier, and any other considerations deemed appropriate by SW Painting Studio.

 

Payment

​

For the initial deposit, only bank transfer is accepted. Upon accepting the commission quote, clients receive an invoice for a 50% deposit, including model costs, payable via bank transfer. All deposits have a 14-day cancellation period, after which they are non-refundable. After project completion and client confirmation, a completion invoice for the remaining sum is sent. Completion payments must be made via a bank transfer before shipment.

Failure to complete the total payment within 14 days of the completion email may result in commission cancellation. In this case, the models become the property of SW Painting Studio, which may sell them to recover financial losses outlined in the Non-Payment section.

SW Painting Studio reserves the right to grant payment extensions on a case-by-case basis, requiring written agreement.

 

Cancellations & Non-Payment

​

Should you choose to cancel a project before work has begun, after a deposit has been made, costs may apply if materials have been sourced by SW Painting Studios. In this case, we will send the purchased kits and materials to you, with postage expenses covered by your deposit. The remainder of the deposit funds will be refunded.

​

Once a project begins work, should you wish to cancel, a fair and proportionate amount will be charged to cover the work that has been done thus far. Should this exceed the deposit amount paid, further funds will need to be paid by the client to meet the balance for the project models to be released. Suppose an army commission is quoted at £1400. The client pays an initial 50% deposit of £700. Out of this deposit, £400 is utilized to cover the cost of the models, leaving £300 from the deposit. At 50% progress, the client has paid a total of £500 (£700 initial deposit - £400 for model cost + £300 remaining from deposit). If, at this point, the client decides to cancel, a cancellation charge of £250 is applied. Therefore, the refundable amount would be £500 (total paid) - £250 (cancellation charge) = £250. The client would receive a refund of £250, and the project will be returned to them.

Should a client needs to defer payment upon completion, for reasons such as unforeseen financial hardship, they can request temporary storage of the commission. The decision to store the project is at our discretion and incurs a fee, determined by factors like required storage space and duration. This fee is added to the original completion invoice and presented to the client. Storage is available for up to two months, after which full payment, as per the amended invoice, is required. If the client declines the storage fee, the project enters a 7-day completion payment period, as outlined in the Non-Payment section. If storage is agreed upon but payment is not made by the end of the agreed storage period, the project enters the 7-day completion payment period.

If the completion invoice is not settled within the specified time, the client will receive a final warning, providing them with a seven-day window to resolve the bill. Failure to do so will result in the models being put up for sale to recoup the debt.

​

If the sale covers the studio's costs, any surplus funds will be refunded to the client. Should the sale not cover the project's costs, an invoice for the remaining services will be issued.

​

If the total completion payment isn't received within 14 days of sending the completion email, we reserve the right to cancel the commission with no refund or product sent to the client. In this case, all models from the commission become the sole property of SW Painting Studio, which may sell them to recover any financial loss.

 

Postage & Shipping

​

Shipping charges associated with your commission will be included in the quote. For domestic shipments, Royal Mail's "Signed For" and "Special Delivery" services are used, and for international shipping, DHL and Parcel Force's "International Tracked & Signed For" are employed.

Shipping fees are determined by factors such as weight, parcel size, time for staff checks and secure packing, and the destination.

All postage is fully insured for the model kits and labour value with no exceptions. We are not responsible for postal service negligence leading to damage or loss under any circumstances.

For commissions shipped outside the UK, please be aware that your shipment may incur import duties and taxes upon reaching the destination country. You, as the client, are responsible for any charges related to customs clearance, acknowledging that SW Painting Studio has no control over these additional fees. As the importer of record, you must comply with the laws and regulations of the destination country.

​

When sending a package to SW Painting Studio, you accept responsibility for any import charges that SW Painting Studio may be required to pay for the release of your package. If these charges are not covered by you, the package will remain uncleared in customs until the customs authorities take the next step, a process beyond the control of SW Painting Studio.

 

Legal Jurisdiction

​

This agreement is governed by the laws of the United Kingdom.

 

By commissioning a painting from SW Painting Studio, the client acknowledges and agrees to abide by these terms and conditions.
